This Privacy Policy describes that services of TORCH, inc.(hereinafter referred to as the “TORCH”, or “we”) have adopted the following Privacy Policy regarding the handling of user information, including personal information about users.

When using any of our Services(hereinafter referred to as the “Service”), you consent to collect, transfer, manipulate, store, disclose, and other uses of your information as described in this Privacy Policy. Irrespective of which country you reside in or supply information from, you authorize TORCH to use your information in Japan and any other country where TORCH operates.

1. User Information

In this Policy, “User Information” means identifying the user, history of activity on the Services, and any other information generated or stored in relation to the user or the user’s terminal, which is collected by TORCH by this Policy.

The User Information we collect on the Service, depending on how it is collected, may include the following:

a. Information Provided by Users.

  • Your name, date of birth, gender, occupation, and other profile information.
  • Contact information such as email address, telephone number, address.
  • Still image information, including the user’s portrait.
  • Information entered or transmitted by the user through the input form or other methods specified by TORCH.

b. Information that you provide through other services when you use it by allowing other services to collaborate with you.

  • IDs used by the user on the Service.
  • Other information that the user has authorized to be disclosed to the collaborators based on the external service’s privacy settings.

c. Information we collect when you use the Service.

  • IP address.
  • Information about server access logs.
  • Cookies, ADID, IDFA, and other identifiers.

d. Information collected by TORCH based on your consent in using the Service.

2. Purpose of using User Information

The personal data and sensitive personal data will be stored, processed, used, and disclosed by us in the following ways:

a. To provide the Service to you and to facilitate the recruitment process to assess data about you against vacancies which we judge may be suitable for you.

b. To send your information to clients to apply for jobs or to assess your eligibility for jobs.

c. To enable you to submit your CV, apply online for jobs, or to subscribe to alerts about jobs we think may be of interest to you.

d. To enable us to develop and sell other products and services, improve our customer service, and make our services more valuable to you.

e. To send you details of reports, promotions, offers, networking and client events, and general information about the industry sectors which we think might be of interest to you

f. To provide third party services that you or our client have requested, such references, qualifications, and criminal reference checking services, verification of the details you have provided from third party source or skill test.

g. To third parties who perform functions on our behalf and who also provide services to us, such as professional advisors, IT consultants carrying out testing and development work on our business systems, research and mailing houses, and outsourcing partners.

h. To regulatory or law enforcement agencies if we believe in good faith that we are required by law to disclose it in connection with the detection of crime, the collection of taxes or duties, to comply with any applicable law or order of a court of competent jurisdiction, or in connection with legal proceedings.

i. To use your information on an anonymized basis to monitor compliance with our equal opportunities policy.

j. To measure users’ traffic and behavior.

k. To deliver and display advertisements and to measure their effectiveness.

l. To answer your questions and inquiries.

3. Providing personal information to a third party

We reserve the right to transfer User Information to a third party in the event of a sale, merger, liquidation, receivership, or transfer of all or substantially all of the assets of our company provided that the third party agrees to adhere to the terms of this Policy and provided that the third party only uses User Information for the purposes that you provided it to us. You will be notified in the event of any such transfer, and you will be afforded an opportunity to opt-out. As a general rule, TORCH does not provide personal information to a third party without the user’s consent. However, on the following occasions, not conflicting with the applicable laws and regulations, we may provide personal information without the user’s consent.

a. When TORCH outsources all or part of User Information’s handling to a third party to the extent necessary to achieve its purpose.

b. When it is judged that the user exerts a disadvantage to a third party.

c. When we are required to disclose User Information by the agency, such as a court or police, the agency has the authority.

d. When we are asked to provide or disclose to any third party which is explicitly admitted by the user.

e. When the provision or disclosure is permitted by law.

4. User Information Management

The User Information you provide to us (including sensitive personal information) may be accessible by TORCH Inc. employees, clients, and the third parties specified above. Some of these TORCH employees, clients, and third parties are located outside Japan. Accordingly, your User Information will be sent to or be capable of being accessed from outside Japan. When we transfer User Information outside Japan, we will take steps with the aim of ensuring that your privacy rights continue to be protected as outlined in this Privacy Policy.

Your information is held on servers hosted by us or our Internet Services Provider. The nature of the internet is such that we cannot guarantee or warrant any information you transmit to us via the internet.

User Information provided to the companies upon the users’ consent is managed according to the applicant companies’ User Information management rules. For each company, TORCH strives to properly manage User Information within the scope of the purposes of use.

5. Correction of personal information

Users can view, revise, add, delete, and write off the personal information that has been registered in the Service at any time. You may request us to confirm what information we hold about you at any time and may request us to modify, update, or delete such information. We may ask you to verify your identity and for more information about your request.

6. Restriction on acquiring sensitive personal information

TORCH does not acquire the following personal information. However, it is not limited if the user voluntarily provides.

a. Thought and religious beliefs.

b. Race, ethnicity, family origin, physical and mental disability, criminal history, and other social discrimination.

c. Matters related to acts of collective action and further collective bargaining.

d. Participation in group industrial action, the exercise of the right of petition, and other matters relating to political rights exercise.

e. Sex lives and health.

7. Google Analytics uses Display Advertising.

The Google Analytics features we’ve implemented based on Display Advertising (e.g., Remarketing, Google Display Network Impression Reporting, the DoubleClick Campaign Manager integration, or Google Analytics Demographics and Interest Reporting). We use Google’s Interest-based advertising or 3rd-party audience data (such as age, gender, and interests) with Google Analytics. Visitors can opt-out of Google Analytics for Display Advertising and customize Google Display Network ads using the Ads Settings.

8. Changes to this Policy

We may revise this Privacy Policy from time to time. The most current version of the Policy will govern our use of your information. Any changes to this Privacy Policy will be posted on this website, so you are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it.

If at any time we decide to use Personal Data in a manner significantly different from that stated in this Privacy Policy or otherwise disclosed to you at the time it was collected, we will notify you by email, and you will have a choice as to whether or not we use your information in a new manner.

By continuing to access or use the Services after those changes become effective, you agree to be bound by the revised Privacy Policy.
